This Claim Form is provided for Settlement Class Members. You are a member of the Settlement Class if you are a person to whom Turnkey provided notification that his or her personal information might have been compromised in the Data Security Incident that occurred on or about September 10, 2021. The Settlement Class specifically excludes (i) all Settlement Class Members who timely and validly request exclusion from the Settlement Class; (ii) the Judge assigned to evaluate the fairness of this settlement; and (iii) any other Person who is found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity occurrence of the Data Security Incident or who pleads nolo contendere to any such charge.

The following benefits are available to Settlement Class Members:

*Documented Economic Losses incurred as a result of the Data Security Incident may include unreimbursed losses relating to fraud or identity theft, professional fees including attorneys’ fees, accountants’ fees, bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel; and fees for credit reports, credit monitoring, or other identity theft insurance product purchased following the expiration of the credit monitoring and identify theft insurance coverage that was offered at the time of notification.

Documented Economic Losses must (i) be actual, documented and unreimbursed monetary loss; (ii) more likely than not been caused by the Data Security Incident; and (iii) the claimant is required to have made reasonable efforts to avoid, or seek reimbursement for the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance.

Third-party documentation can include receipts or other documentation not “self-prepared” by the Settlement Class Member that documents the costs incurred. Self-prepared documents such as handwritten receipts are, by themselves, insufficient to receive reimbursement, but can be considered to add clarity or support other submitted documentation.

II. CREDIT MONITORING & IDENTITY RESTORATION SERVICES

If you select this benefit, you will be sent an activation code after the Settlement is final. You will need to follow the instructions and use the activation code that you receive to enroll in the credit monitoring and identity restoration services. Credit monitoring protections will not begin until you use your activation code to enroll in the services.

III. DOCUMENTED ORDINARY LOSSES UP TO $350

Supporting documentation must be provided. You may mark out any transactions that are not relevant to your claim before sending in the documentation. Settlement Class Members are eligible for compensation for unreimbursed ordinary losses up to a total of $350.00 per Settlement Class Member, upon submission of a valid Claim Form and supporting documentation.

IV. DOCUMENTED EXTRAORDINARY LOSSES UP TO $5,000

Settlement Class Members are eligible for compensation for extraordinary losses up to $5,000 per Settlement Class Member, provided that the Documented Economic Losses must (i) be actual, documented and unreimbursed monetary loss; (ii) more likely than not been caused by the Data Security Incident; and (iii) the claimant is required to have made reasonable efforts to avoid, or seek reimbursement for the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance.

Documentation of the extraordinary loss is required. The loss must be more likely than not the result of the Data Security Incident and must not already be covered by the ordinary losses reimbursement.

V. COMPENSATION FOR LOST TIME

Settlement Class Members may also submit a Claim Form seeking payments for up to four (4) hours of Lost Time since September 10, 2021 at $25.00/hour, if at least one (1) full hour was spent remedying fraud, identity theft, or other alleged misuse of personal information fairly traceable to the Data Security Incident or spent on preventative and remedial measures to protect personal information that are fairly traceable to the Data Security Incident.

In order to receive this payment, you must describe what you did and how the claimed lost time was spent related to the Data Security Incident. Examples of compensable lost time include: Investigating credit history for potential fraudulent transactions; communicating with credit reporting bureaus; communicating with bank/credit card customer service lines regarding potential fraudulent transactions, changing cards or accounts; time on the internet addressing potentially fraudulent transactions; and time on the internet investigating identity theft or credit protection measures, products or services.
